Conditions of sale
All wines are offered subject to availability and price change. Orders have to be confirmed in writing by LA BERGERE VINTNERS until stocks last.
Prices - minimum order
Prices are in Euros, excluding French taxes (VAT 19,6%), ex-cellars ORGERUS (78) (EX-WORKS, EXW). Errors or omissions excepted. Minimum order is 1500€
VAT
European Union regulation
I. Delivery to countries within the European Union:
- • If the consignee (delivery address) is exempt from VAT in the country of delivery: the order will be invoiced exclusive VAT, after having verified the VAT identification number of the consignee.
- • If the consignee (delivery address) is NOT exempt from VAT in the country of delivery: the order will be invoiced inclusive French VAT (except for Germany and Austria, for which we are entitled to apply the local VAT).
II. Delivery outside the European Union: The order will be invoiced ex. VAT and ex. taxes.
Packaging and minimum quantity
The wines are sold in the indicated packaging. Bottles can be purchased by unit if the case had been opened before. In that case, they cannot be delivered in their original wooden case.
Availability
All the wines are stored in our air-conditioned cellars (78 ORGERUS/ 33 BORDEAUX- France) and therefore immediately available, except for futures.
Damages
Wines are transported at the client's risk. We do our utmost to ensure that wines are forwarded under optimum conditions. Nevertheless should you notice damage upon delivery, please mention it on the delivery note and fax this to us within 3 days as an acknowledgement of receipt.
Futures / "en Primeur" purchases - special terms
"En Primeur" is a French expression for a wine which is sold as a future, i.e. before it is bottled and released onto the market. Delivery of futures is made according to their availability.
- • Primeur/Futures 2009: autumn 2011/spring 2012
- • Primeur/Futures 2010: autumn 2012/spring 2013
You can order en primeur at many times. We will try to merge your orders into a single delivery. Of course, if you have paid the delivery charges on several occasions we will refund you the over-payment. In the case of non-payment, we reserve the right to cancel your order without any further notice. If at the time of delivery the fiscal or special taxation such as VAT have increased, we would proceed to update our invoice accordingly.
Payment
Payment should be made within 30 days following the order. Payment by bank transfer.
Cork failure
According to international practices we cannot exchange corked bottles.
Old wines
All our wines are stored under ideal conditions in our air-conditioned cellars of LA BERGERE 78 ORGERUS and BORDEAUX 33. However, we cannot guarantee the perfect state and quality of wines older than 10 years.
General
Wines remain the property of LA BERGERE until payment has been received in full, even if the goods have been resold to a third party.

Special offers that become available on this web site can never be claimed together with other special offers, and are granted upon conditions.
Exclusivities
Please note that some wines are exclusive and may not be delivered in certain countries.
Bottle descriptions, label state, level of wine, etc...
Please note that wines in original wooden cases and without any specific description are in perfect condition regarding level of wine, label, or cap. Wines that are packed in standard wooden/cardboard cases without any specific description could be slightly different from one bottle to another. For wines older than 15 years (or more) the state of the bottle corresponds to its age, and is generally comparable to the state of the bottles in the same vintage.
